




The Jharkhand High Court has initiated suo motu contempt proceedings against a lawyer after witnessing a heated exchange between this lawyer and a judge on October 16.
A video of the incident went viral on social media and shows the incident took place inside the court whose order revealed that tensions rose immediately after Justice Sanjay Kumar Dwivedi rejected the anticipatory bail petition filed by the accused in the land dispute.
The court said the petitioner’s lawyer started “arguing with the court in a loud voice” and “threatened the court” by saying that he would approach the Supreme Court.
The case dates back to October relates to a dispute between the petitioners and an 80-year-old informant. The petitioners were apprehensive about arrest in connection with a case of attempted culpable homicide under the Bharatiya Nyaya Sanhita, 2023.
The court said the lawyer’s behaviour, described as “hooliganism,” was witnessed by several members of the bar, including a senior counsel.
Following the escalation, Jharkhand State Bar Council chairman Rajendra Krishna appeared in court and said the court to avoid initiating criminal contempt proceedings.
A full bench, comprising Chief Justice Tarlok Singh Chauhan, Justice Sujit Narayan Prasad, Justice Rongon Mukhopadhyay, Justice Ananda Sen, and Justice Rajesh Shankar, convened to initiate contempt proceedings against the lawyer.
The events leading to the contempt action had unfolded on October 16 in the courtroom of Justice Rajesh Kumar. Advocate Mahesh Tewari was arguing for the client in land dispute case.
During the proceedings, Mr. Tewari had submitted that his client was prepared to deposit Rs 25,000 to facilitate the reconnection. However, Justice Kumar cited a judicial order against such facilitation.
The Jharkhand High Court had earlier asked the State Bar Council to act against this lawyer for threatening the judge who had rejected the anticipatory bail plea of persons accused in a land-grabbing case.The Bar Council has also initiated proceedings against him.
