The state government’s order dismissing Himanshu Choudhary from his post of Chairman, State Food Commission, was arbitrary, ruled the Jharkhand High Court.
In its order, the court has stayed the state government’s order thereby providing relief to Himanshu Choudhary.
A bench of Justice Deepak Roshan, hearing the case also directed the State government that no person should be appointed to the post of State Food Commission without the next order of the high court.
Senior advocate Ajit Kumar, arguing on behalf of Himanshu Chaudhary, among other issues, said that the government order was an open violation of natural justice.
Chaudhary was removed by the state government on July 3. It was unilateral decision without allowing him to explain his stand on the issue raised against him by the government.
Choudhary was made made chairman on August 3, 2021.
