The Special Judge for CBI Cases, Delhi today (09.12.2024)has convicted three accused i.e. Shri Manoj Kumar Jayaswal, Director/Managing Director & Shri Ramesh Kumar Jayaswal, Former Director of accused company M/s Abhijeet Infrastructure Pvt. Ltd (now M/s Abhijeet Infrastructure Ltd.) based at Bhilai/Nagpur and M/s Abhijeet Infrastructure Pvt. Ltd in a Coal Scam Case.
The Central Bureau of Investigation had registered the instant case i.e RC 221 2016 E 0002 on 06.01.2016 under Sections 120-B read with 420 of the Indian Penal Code (IPC) and Sections 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988 against M/s Abhijeet Infrastructure Pvt. Ltd. (now M/s Abhijeet Infrastructure Ltd.) through its directors, unknown public servants and private persons.
The case pertains to the allocation of the Brinda, Sisai, and Meral coal blocks in the State of Jharkhand to the said company. It was alleged that M/s Abhijeet Infrastructure Pvt. Ltd., in conspiracy with public servants, fraudulently and dishonestly obtained the aforesaid coal blocks by misrepresenting its financial position, acquisition of land for its proposed end-use plant, and other related claims.
During the investigation, it was revealed that the company had submitted photocopies of forged and fabricated documents concerning: - Purchase of private land at Hazaribagh, Jharkhand; - Procurement of machinery for the proposed end-use plant; - Financial tie-ups with banks.
These forged documents were used to secure the recommendation of the Ministry of Steel, Government of India, for the allocation of the coal blocks. Based on this recommendation, the Ministry of Coal allocated the Brinda, Sisai and Meral coal blocks to M/s Abhijeet Infrastructure Pvt. Ltd. on 25.06.2005.
The company thus defrauded the Ministry of Coal/Public Exchequer. Upon completion of the investigation, CBI filed a charge sheet on 29.10.2020.
The chargesheet was filed in the Court of the Special Judge, CBI, under Sections 120-B read with 420 and 471 IPC against: - Shri Manoj Kumar Jayaswal, Director/Managing Director; - Shri Ramesh Kumar Jayaswal, Former Director; - M/s Abhijeet Infrastructure Pvt. Ltd. (now M/s Abhijeet Infrastructure Ltd.).
After the conclusion of the trial, the Court of the Special Judge, CBI, Coal Cases (Shri Arun Bhardwaj), Rouse Avenue District Court, Delhi, convicted all three accused. Their sentence will be pronounced later.
During the trial prosecution had examined 38 witnesses and exhibited 74 documents leading to conviction.
