So why question now when Jharkhand DGP Niraj Sinha is re-retiring on February 11, 2023 and the Supreme Court has fixed January 16, 2023, as the date to hear the Contempt petition against the Jharkhand government and others.

The contempt petition has been filed against the state government and others. It is connected with the case of the DGP of Jharkhand Neeraj Sinha. There has been a petition on the charge that he was given an extension and posted as DGP against the Supreme Court’s guidelines.

Also, the contempt petition involves the Union Public Service Commission. This is primarily because the state government has sent a list of senior IPS officers for selection and appointment as a successor of Neeraj Sinha as DGP and the UPSC has raised queries for the state government of Jharkhand to reply.

In response to the contempt petition submission, the apex court division bench comprising chief justice DY Chandrachud and Justice PS Narshimha has directed the state government to abide by rules and regulations and rectify ‘errors’ if any in accordance with the law.

Since DGP Neeraj Sinha, is scheduled to complete the period of extension granted to him, the list of names cited by the state as his successor has been covered by an old fog of the controversy.

The UPSC is learnt to have mailed its letter to the state government on November 30, 2022. After the state government sends its reply on or before December 23, UPSC can take its stand after January 9, 2023.

Now, others facts are: Neeraj Sinha, IPS officer of the 1987 batch, had retired from service on January 31, 2022. But he continued to hold the post of DGP to date due to the extension accorded to him.

Second, just nearly a fortnight after his controversial extension and appointment as DGP of Jharkhand ends on, February 11, the SC is scheduled to hear this case on January 26, 2023.
