In a ruling addressing a service claim that has stretched across decades, the Jharkhand High Court has directed the Jharkhand Tourism Development Corporation to regularise Rakesh Kumar’s service retrospectively from February 20, 2001, along with the consequential benefits.

A Claim Rooted in Long Service

The order was passed by a single bench of Justice Deepak Roshan while hearing Kumar’s long-pending petition. The court noted that he had been serving the corporation continuously since 1993, and that his claim concerned prolonged service without regularisation despite performing duties against sanctioned work.

Kumar argued that denying him regular status and the statutory benefits attached to it after such extended service was unjust. Senior advocate Manoj Tandon represented him.

Benefits to Follow the Effective Date

The court has directed that regularisation take effect from February 20, 2001. The consequential financial and service benefits applicable from that date will therefore form part of the implementation of the order.

The ruling comes as Kumar approaches retirement after more than two decades of service with JTDC, giving a judicial resolution to a dispute that had remained pending for years.

Wider Significance for JTDC Employees

The decision could also draw attention from other JTDC workers who have served for extended periods on daily-wage or contractual arrangements. However, the ruling does not automatically establish regularisation for every such employee; any similar claim would depend on its individual facts and applicable law.
