Jharkhand High Court pulled up the state government over its decision to shift the fodder scam convict Lalu Prasad Yadav from the state government run RIMS hospital ward to its Director's Bungalow.

"The government is run on the basis of law, and not on a special person, observed Justice Amresh Kumar Singh who was responding to a PIL alleging that the state jail manual was violated by the state government by shifting him from RIMS ward to its Director's Bungalow.

The state government's counsel submitted before the court that the state jail manual was not clear as to what ought to be done on grounds of security and health of the prisoner who suffers from multiple diseases."There is no Special Operative Procedure",he said.

Alongside, the counsel of the RIMS justified its decision to transfer him from RIMS ward to its Bungalow on grounds of the threat of COVID- 19."The Bungalow was considered safe",he argued.

However, the RIMS counsel failed to explain if its management considered 'options' before shifting him from its ward to Bungalow.

Records revealed that responding to this PIL last month, the court had sought the state  government's and RIMS' replies and the list of persons with whom Lalu Prasad Yadav had talked on mobile phones.But neither the state government nor the RIMS gave details about it.

The court posted the hearing of this case on January 22.
