Jharkhand High Court has directed the Speaker of the state Assembly to submit its response to the petitioner Babulal Marandi’s allegation of ‘bias’ against his case of defection.

The court will hear the case on October 13.

The Bench of Justice Rajesh Shankar heard the counsel of Babulal Marandi who in his petition has challenged the proceedings initiated by the Speaker against allegation of defection.

In his petition, Babulal Marandi has sought intervention of the court to nullify and put a stay on proceedings initiated by judicial tribunal of the speaker in his defection case. 

The case has its own history.Jharkhand Vikas Morcha was formed by Marandi, who quit BJP, in 2006.Fourteen years later,after 2020 assembly polls, Marandi merged JVM with the BJP. 

This was done after he as chief of JVM suspended his two other party MLAs- Pradeep Yadav and Bandhu Tirkey, who claimed that they represent the real JVM and later merged the party with the Congress.

The Speaker had initiated anti-defection proceedings on his own, but after Marandi challenged his power to suo moto pick up the case, a bunch of complaints were filed. 

The Speaker started hearing these complaints and kept his ruling reserved. Along side Marandi had moved the HC against the Speaker’s proceedings. 

In response, the court has now fixed October 13 to hear the case after receiving its response in the form of an affidavit.
